Toy Tester Terms and Conditions

Because we value the feedback of the community, we’re always on the lookout for people who are willing to give our products a try in return for their unbiased feedback. The following guidelines apply to the relationship between the Parent/Guardian (“Toy Tester”) overseeing the toy testing activities (“toy testing”) and Maison Battat, Inc., its affiliates, successors, and assigns, and their respective licensees, advertising agencies, promotion agencies, and fulfillment agencies, and the employees, officers, directors, and agents of each and all of them (the “Company”) during the usage of the product supplied by the Company (the “Product”).

User Obligations

The Company will supply funds for the Toy Tester to purchase the Product in order to obtain feedback on functionality, design and overall experience of the Product under everyday conditions. Since the product will be purchased at 3rd party retailers, the Company shall have no liability, responsibility nor obligation of any kind to the Toy Tester as to the condition of the Product. The Company is not obligated to provide any additional compensation in connection with the Toy Tester trial use of the Product in this test. The Company is not responsible nor obligated to replace nor repair the Toy even if the same fails under intended and everyday conditions.

The Toy Tester is responsible for limiting use of the Product to purposes for which the Product was designed. The Company hereby reserves the right to terminate the Toy Tester participation in trial at its discretion if it determines that the Toy Tester’s use of the Product has been improper or if a risk exists to further use by Toy Tester.

Toy Tester shall comply with all applicable laws, rules and regulations in connection with any of his/her posts, content, statements and/or reviews, including but not limited to, the Federal Trade Commission Guides Concerning the Use of Endorsements and Testimonials in Advertising, Target’s Terms and Conditions, and Amazon’s Community Guidelines. Toy Tester is solely responsible for any post, content, statement, or review that he/she submits, and Company assumes no liability for any such post, content, statement or review. Toy Tester shall include appropriate language in any post, content, or review to clearly and conspicuously disclose the connection to Company, such as the following example language:

• “I want to say thanks to Battat for sending me funds to purchase this toy for free to share this information with you. All thoughts on this toy are my own.”

• “Please note that although I received consideration from Battat to purchase this toy for review purposes, the opinions are completely my own based on my experience.”

User Eligibility

A Toy tester must be over the age of 18 or the age of maturity in their jurisdiction.

A Toy Tester must not be employed by a competitor in the toy or games industries and cannot otherwise have a conflict of interest with the Company, and will not use the information about the Product testing or the Product itself for any purpose other than performing this product testing for the Company and reporting of the same to the Company.

Use of Toy Tester Comments

During and after the Testing Period, The Company will ask the Toy Tester to provide feedback on the Product’s performance within a specified timeframe. The Toy Tester will do his/her best to commit to respect the given timeframe and grant to The Company his/her permission to use the feedback for the purposes of subsequent product development and product promotion. By providing feedback, the Toy Tester represents to The Company that such feedback reflects his/her good-faith opinion of the Product and that he/she is not being influenced by another.
